Terms of Service

Welcome to Pawstify. These Terms of Service ("Terms") govern your use of the website pawstifypets.com and the Pawstify mobile application (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the service

Pawstify provides tools to help you manage your pet's health records, including vaccines, medications, reminders, and related information. The app is designed to work offline-first, with data stored on your device. The Service is currently offered as a beta; features, availability, and pricing may change.

2. Eligibility and account

You must be at least 13 years old to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account.

3. Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not: (a) use the Service in any way that violates applicable laws or regulations; (b) attempt to gain unauthorized access to the Service, other accounts, or any systems or networks; (c) use the Service to transmit malware, spam, or harmful content; (d) interfere with or disrupt the Service or servers or networks connected to the Service; (e) use the Service to collect or harvest personal information of others without consent; or (f) use the Service for any purpose that is harmful, fraudulent, or misleading. We may suspend or terminate your access if we believe you have violated these Terms.

4. Your content and data

You retain ownership of the data and content you submit through the Service (e.g. pet health records). By using the Service, you grant us a limited license to use, store, and process that data as necessary to provide, maintain, and improve the Service, and as described in our Privacy Policy. You are responsible for the accuracy of the information you provide. The Service is not a substitute for professional veterinary advice; always consult a licensed veterinarian for medical decisions.

5. Intellectual property

The Service, including its design, text, graphics, logos, and software (excluding your content), is owned by Pawstify or its licensors and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

6. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. THE SERVICE IS NOT INTENDED TO DIAGNOSE, TREAT, OR REPLACE PROFESSIONAL VETERINARY CARE.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAWSTIFY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (USD $100), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN SUCH CASES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

8. Indemnification

You agree to indemnify, defend, and hold harmless Pawstify and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your content, or your violation of these Terms or any law.

9. Beta and changes

The Service may be offered as a beta or pre-release product. Features, availability, and pricing may change. We may modify, suspend, or discontinue the Service or any part of it at any time, with or without notice. We may also update these Terms; we will post the updated Terms on this page and update the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

10. Governing law and disputes

These Terms shall be governed by and construed in accordance with the laws of the Philippines, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or the Service shall be resolved exclusively in the courts located in the Philippines. You waive any objection to jurisdiction and venue in such courts.

11. General

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision does not constitute a waiver of that right or provision. These Terms constitute the entire agreement between you and Pawstify regarding the Service and supersede any prior agreements.
